This Privacy Policy describes the ways in which Abacus Analytical System GmbH (“ABACUS“) and its subsidiaries collect, store and use information about individual persons who visit this website or submit information to us by other means.

YOU ALSO ACKNOWLEDGE THAT ABACUS MAY PERIODICALLY CHANGE, MODIFY, ADD OR REMOVE OR OTHERWISE UPDATE THIS PRIVACY POLICY AT ITS DISCRETION, WITHOUT PRIOR NOTIFICATION.

 

We may decide to change this privacy policy from time to time. Should we do so, we will immediately post changes to our privacy policy on this page so that you are fully informed concerning the types of information we are gathering, how we use it, and under what circumstances it may be disclosed. The term “Personal Data” as used in this Privacy Policy refers to information such as your name,  e-mail address, mailing address, or telephone number that can be used to identify you. In particular, we will record information that you submit to us via our website, in particular information entered in our online tools (Abacus academy etc.). ABACUS does not collect sensitive personal data (e.g. data relating to: your religious or political beliefs, your health or your race, etc.). Generally, we will only process your Personal Data as described in this Privacy Policy. However, we reserve the right to conduct additional processing to the extent permitted or required by law, or in support of any legitimate requests filed by authorities.

  1. Intended use of Personal Data

Most of our services do not require any form of registration, allowing you to visit our site without telling us who you are. However, some services may require you to provide us with Personal Data. In these situations, if you choose to withhold any Personal Data requested by us, it may not be possible for you to gain access to certain parts of the site or to conduct business with us and for us to respond to your query.

We may collect and use Personal Data to provide you with products or services, to bill you for products and services you request, to market products and services which we think may be of interest to you, to contact you with information about updates to our website or other marketing information or to communicate with you for other purposes which are evident from the circumstances or about which we inform you when we collect Personal Data from you.

  1. Storage of Personal Data

ABACUS generally stores the personal data collected for 10 years after the last processing operation in order to comply with statutory accounting requirements. We store other data as long as is necessary for the execution of the contract and to safeguard our rights. We reserve the right to apply longer statutory and operational storage requirements and reasons.

Personal data collected for marketing activities is generally deleted as soon as the purpose of the activity has been met.

Furthermore, Personal Data may be disclosed to a third party if we are required to do so because of an applicable law, court order or governmental regulation, or if such disclosure is otherwise necessary in support of any legitimate requests filed by authorities.

  1. Non-disclosure of Personal Data

We will not sell, share, or otherwise distribute your Personal Data to third parties except as provided in this Privacy Policy. We may disclose your Personal Data to other ABACUS affiliates worldwide that agree to treat it in accordance with this Privacy Policy. Personal Data may also be transferred to third parties who act for or on our behalf, for further processing in accordance with the purpose(s) for which the data were originally collected or may otherwise be lawfully processed, such as services delivery, marketing, data management or technical support. These third parties have contracted with us to only use Personal Data for the agreed upon purpose, and not to sell your Personal Information to third parties, and not to disclose it to third parties except as may be required by law, as permitted by us or as stated in this Privacy Policy. Should processing by these third parties require transfer of data abroad, please refer to section ‎8 of this policy.

Furthermore, Personal Data may be disclosed to a third party if we are required to do so because of an applicable law, court order or governmental regulation, or if such disclosure is otherwise necessary in support of any legitimate requests filed by authorities including regulatory bodies of stock exchanges.

  1. Right of access, correction and objection

According to applicable data protection laws, you have the right to object to the processing of your Personal Data if such processing is not reasonably required for the execution of a contract or a legitimate business purpose as described in this policy. In the case of electronic direct marketing, we will provide you with a method to opt out of receiving further marketing materials or with a method to opt in if required by law. If, due to your objection, ABACUS is no longer able to perform the services contractually agreed with you, the objection is deemed a breach of contract by you and ABACUS has the right to terminate its contract with you without notice.

  1. Security and confidentiality

To ensure the security and confidentiality of Personal Data that we collect, ABACUS has established appropriate technical and organizational security measures and we use data networks protected, inter alia, by industry standard firewall and password protection. In the course of handling your Personal Data, we take measures reasonably designed to protect that information from loss, misuse, unauthorized access, disclosure, alteration or destruction.

However, you acknowledge that any information sent via the Internet is not secure. This data can be accessed by unauthorized third parties, potentially leading to disclosures, changes in content or technical failure. ABACUS is not responsible or liable for the security of your data whilst in transit via the Internet to us. Please use other means of communication if you think this is necessary for security reasons.

  1. Data transfer abroad

ABACUS is a global working company and has databases in different countries, some of which are operated by the local ABACUS Company, and some of which are operated by third parties on behalf of the local ABACUS Company. These third parties may be located outside the EU or abroad, also in countries where legislation does not guarantee appropriate levels of data protection. However, we are committed to take all necessary measures to comply with all local and worldwide privacy laws, the General Data Protection Regulation of the European Union and the United States Department of Commerce Privacy Shield frameworks. In the case of the transfer of data to countries without appropriate levels data protection, ABACUS ensures that the respective protection of Personal Data is assured by signing data processing agreements, e.g. based on standard contractual clauses of the EU.

  1. “Cookies” and Log Files

We may collect and process information about your visit to this website, such as the pages you visit, the website you came from and some of the searches you perform. Such information is used by us to help improve the contents of the site, to map usage patterns and to compile aggregate statistics about individuals using our site for internal, market research purposes. In doing this, we may install “cookies” that collect the domain name of the user, your internet service provider, your operating system, and the date and time of access. An internetworking protocol address (“IP address“) is a 32-binary digit number automatically assigned to your computer on connecting to the Internet that identifies each sender or receiver of information. We may use IP addresses to analyze trends, administer the site, track user’s movements, and gather broad demographic information for aggregate use. We store log files of these IP addresses for administrative, security and statistical purposes. However, those addresses are not linked to Personal Data.

Google Tag Manager

Google Tag Manager is a solution with which we can manage so-called website tags via an interface (and thus integrate Google Analytics and other Google marketing services into our online offering). The Tag Manager itself (which implements the tags) does not process any personal user data. Google Analytics

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer in the sense of Art. 6 Para. 1 lit. f. of the German Civil Code), we act in accordance with the following principles DSGVO) Google Analytics, a web analysis service of Google LLC (“Google”). Google uses cookies. The information generated by the cookie about users’ use of the website is generally transmitted to and stored by Google on servers in the United States.

Google is certified under the Privacy Shield Agreement and thus offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use Google Analytics only with activated IP anonymization. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user’s browser is not merged with other Google data. The personal data of the users will be deleted or anonymized after 14 months.
